End User License Agreement (EULA)

Hiive grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Licensed Application on any authorized Apple-branded or mobile device running an operating system supported by Hiive, strictly for your personal, non-commercial use, subject to this Agreement and applicable App Store Terms of Service.

You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof.

Hiive strictly enforces a ZERO-TOLERANCE policy regarding objectionable content, harassment, abuse, and prohibited behavior. There is NO tolerance for objectionable content or abusive users on the Platform.

Prohibited content includes, but is not limited to: hate speech, discrimination, harassment, threats, physical violence, sexually explicit material, profanity, bullying, illegal activity promotion, spam, malware, fraud, impersonation, or infringement of third-party privacy or intellectual property rights.

Any user who uploads, posts, transmits, or shares objectionable content, or engages in abusive behavior toward other users, will face immediate account suspension or permanent termination without notice, and objectionable content will be removed promptly.

The Licensed Application allows users to post profiles, create games, host events, share sports activities, submit comments, and communicate with other users ("User-Generated Content" or "UGC").

You retain ownership of the UGC you submit. However, by uploading or sharing UGC through the Platform, you grant Hiive a worldwide, perpetual, royalty-free, transferable license to store, host, display, reproduce, and distribute such content for the operation of the Platform.

You represent and warrant that all UGC submitted by you complies with all applicable laws, does not violate any third-party rights, and strictly complies with the Zero-Tolerance Policy set forth in Section 2.

Hiive utilizes automated filtering tools and human moderation teams to review UGC posted on the Platform.

Hiive commits to reviewing all user reports and flagged content within 24 hours of receipt. Content deemed objectionable, abusive, or in violation of this EULA will be removed immediately upon review, and appropriate enforcement actions will be taken against the offending user account.

The Licensed Application provides built-in reporting mechanisms for users to flag objectionable content, abusive comments, inappropriate event listings, or unlawful posts.

To report content within the mobile app: (a) Tap the 'Options' menu (represented by three dots `...` or a flag icon) adjacent to any post, comment, event, or profile; (b) Select 'Report / Flag Content'; (c) Choose the reason for reporting (e.g. Harassment, Hate Speech, Inappropriate Content, Spam); (d) Submit your report.

You can also report objectionable content directly to our safety team by emailing jai@hiive.club with details, screenshots, and user identifiers.

The Licensed Application empowers users to instantly block any abusive, harassing, or unwanted user to prevent further communication and hide shared content.

To block a user within the mobile app: (a) Navigate to the user's profile or tap their avatar; (b) Tap the 'Options' menu (`...`); (c) Select 'Block User'; (d) Confirm the block action.

Once a user is blocked: (i) They will no longer be able to message you, view your profile, or join private sessions hosted by you; (ii) Their content will be hidden from your feed and activity views immediately.

Hiive reserves the right, in its sole and absolute discretion, to monitor, restrict, suspend, or permanently ban any user account, at any time, with or without notice, for violating this EULA, posting objectionable content, or engaging in abusive behavior.

Upon termination of your account, your right to access or use the Licensed Application ceases immediately, and all licenses granted hereunder terminate.

Your privacy is important to us. By accepting this EULA, you also acknowledge that your data will be collected and processed in accordance with the Hiive Privacy Policy (available at https://hiive.club/privacy-policy).

The Licensed Application uses third-party analytics and measurement providers, including PostHog for product analytics and Meta Platforms (Meta SDKs in the app, and Meta Pixel and the Conversions API on our website) for advertising measurement. These providers collect and process information about your use of the Licensed Application, such as device and usage data, screens viewed and conversion events, as described in the Privacy Policy.

Sharing advertising measurement signals with Meta is optional and off until you allow it. You can manage or withdraw that choice at any time at https://app.hiive.club/privacy/ad-measurement or through Ad Measurement in the app, and on iOS through App Tracking Transparency in your device settings. Declining does not affect your access to the Licensed Application.

THE LICENSED APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HIIVE INTELLIGENCE PVT. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL ARISING FROM OR RELATING TO YOUR USE OF THE LICENSED APPLICATION OR ANY USER INTERACTIONS.

Acknowledge of Parties: This EULA is concluded between you and Hiive only, and not with Apple Inc. ("Apple"). Hiive is solely responsible for the Licensed Application and content thereof.

Maintenance and Support: Hiive is solely responsible for providing any maintenance and support services with respect to the Licensed Application as specified in this EULA or required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services.

Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

This EULA is governed by and construed in accordance with the laws of India. Any legal action or proceeding arising out of this Agreement shall be brought exclusively in the competent courts located in Mumbai, Maharashtra, India.
